1. Acceptance of Terms
By accessing and using Bütçe Gardiyanı services ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.
2. Age Requirement
You must be at least 18 years old to use our Services. Individuals under 18 may not register for or use our Services.
3. Description of Services
Bütçe Gardiyanı provides click fraud protection services for Google Ads campaigns. Our Services include visitor tracking, suspicious IP detection, and automatic IP blocking through the Google Ads API.
4. Account Registration
To use our Services, you must create an account with accurate and complete information. You must provide a valid email address during registration. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4.1 Email Verification
To activate your account, you must enter the verification code sent to your email address during registration. Accounts that are not verified within the designated period are automatically deleted along with associated data.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Use the Services to harm competitors or third parties
- Reverse engineer or attempt to extract source code
- Scrape, mine, or collect data from the Services using automated methods (bots, crawlers, scrapers, etc.)
- Systematically copy or download any portion of the Services using automated tools
6. Payment and Billing
Subscription fees are billed in advance on a monthly or annual basis.
- Prices are subject to change with 30 days notice
- All fees paid are non-refundable; upon cancellation, service continues until the end of the billing period
- Cancellation takes effect at the end of the billing period
- Payments are processed through a third-party payment service provider; full payment card numbers and billing address details are not stored in our systems and are transmitted directly to the payment service provider. However, for recurring payments, your phone number, card last 4 digits, card type, and encrypted payment token information are stored in our systems.
- During checkout, acceptance records for the Pre-Information Form and Distance Sales Contract (including agreement content, acceptance date, IP address, and browser information) are maintained in compliance with our legal obligations
7. Free Trial
Bütçe Gardiyanı offers a 7-day free trial period to newly registered users.
- The trial period begins upon completion of email verification and lasts 7 days
- There is no automatic transition to a paid subscription at the end of the trial period
- When the trial period expires, the protection service is paused; suspicious clicks continue to be detected but are not blocked
- The customer must actively subscribe to continue protection
- Data collected during the trial period is processed in accordance with our Privacy Policy
- Bütçe Gardiyanı reserves the right to modify free trial terms without prior notice
8. Data and Privacy
Your use of the Services is subject to our Privacy Policy and Data Processing Agreement.
By using the Services, you also agree to our Data Processing Agreement (DPA). The DPA governs the rights and obligations of the parties regarding the processing of personal data in accordance with GDPR Article 28.

9. Intellectual Property
All intellectual property rights in the Services, including software, algorithms, and documentation, remain the property of Bütçe Gardiyanı. You are granted a limited, non-exclusive license to use the Services during your subscription.
The following activities are strictly prohibited:
- Analyzing the Services for the purpose of developing a similar or competing product or service (competitive benchmarking)
- Reverse engineering, decompiling, disassembling, or extracting the source code of the Services' software
- Scraping, copying content, or systematically collecting data from the Services through automated or manual methods
- Copying, reproducing, or imitating any component, feature, or functionality of the Services
10. Google Ads API Dependency
Our Services operate in dependency on the Google Ads API. You acknowledge the following:
- Google may change, restrict, or discontinue its API without prior notice
- Changes to the Google Ads API may temporarily or permanently affect the functionality of the Services
- Bütçe Gardiyanı shall not be held liable for service interruptions, data loss, or reduced functionality resulting from Google's decisions or API changes
- In the event that the Google Ads API becomes unavailable, Bütçe Gardiyanı will endeavor to provide alternative solutions within a reasonable timeframe; however, this is not guaranteed
11. Indemnification
You agree to indemnify, defend, and hold harmless Bütçe Gardiyanı, its directors, employees, and agents from and against all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from your use of the Services or your violation of these Terms. This obligation specifically covers the following situations:
- Your infringement of third-party intellectual property rights, privacy rights, or other legal rights while using the Services
- Your violation of any provision of these Terms
- Your unlawful or unauthorized use of the Services
- Unauthorized activities conducted through your account
12. Limitation of Liability
To the maximum extent permitted by law, Bütçe Gardiyanı shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Services. Our total liability shall not exceed the amount paid by you for the Services in the 12 months preceding the claim.
The following are excluded from this limitation of liability:
- Damages arising from intent or gross negligence
- Damages resulting from unlawful processing of personal data
- Cases causing death or bodily harm
- Cases where applicable law prohibits limitation of liability
13. Force Majeure
Neither party shall be held liable for failure to fulfill its obligations due to events beyond its reasonable control that could not have been foreseen. Such events include but are not limited to:
- Natural disasters, war, acts of terrorism
- Epidemics and pandemics
- Internet infrastructure outages, cyber attacks
- Third-party service provider outages (including Google Ads API)
- Government interventions, legal restrictions
During the force majeure period, the affected party's service obligations are suspended. If the force majeure event lasts more than 90 days, either party may terminate the agreement.
Force majeure does not affect the customer's account status or membership — it only limits Bütçe Gardiyanı's liability arising from service interruptions.
14. Disclaimer of Warranties
The Services are provided "as is" without warranties of any kind. We do not guarantee that the Services will detect all fraudulent clicks or prevent all invalid traffic. Click fraud protection is a best-effort service based on our detection algorithms.
15. Termination
We may terminate or suspend your account for violation of these terms. You may cancel your subscription at any time. Upon termination, your right to use the Services will cease immediately.
16. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Republic of Turkey.
Dispute Resolution:
- The parties agree to first attempt resolution through good faith negotiation (30 days)
- Disputes that cannot be resolved through negotiation shall be referred to mediation
- Disputes that cannot be resolved through negotiation or mediation shall be subject to the exclusive jurisdiction of the Bilecik Courts and Enforcement Offices
For customers residing in the EU, the local data protection authority also has jurisdiction over GDPR-related disputes.
17. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via email or through the Services at least 30 days before they take effect.
